It's not about "early", it's about "anywhere". And at the moment ls is being used (at least) in sys/boot/i386/boot2/Makefile, lib/libcompat/i386/Makefile and in sys/conf/Makefile*
You sure about libcompat/i386?

my bad. lib/compat/i386. This can use "echo".

This won't work. The "ls" is to check for files (non-zero output). Your echo will always have an output. Either the list of files or the string you passed when the shell just can't glob it.
